The seat of Justice Md Abu Zafor Siddique passed the request.

Prior, five HC judges declined to hear a similar request of after a two-judge seat on December 6, 2016, conveyed a split decision.

Shakhawat Hossain Bhuiyan, a Jubo League pioneer of Feni, documented the request of as open intrigue prosecution with the HC on June 8, 2014, imploring the court to pronounce Nizam excluded for challenging the parliamentary surveys and holding the workplace as a legislator in view of his claimed fabrication in getting an early discharge from imprison in a criminal case.

Citing a daily paper report, Shakhawat in his request of said a Chittagong court condemned Nizam to 10 years’ detainment in an arms case on August 16, 2000. He surrendered to the court on September 14, 2000, and was sent to Chittagong correctional facility to serve his term.

In any case, he was discharged on December 1, 2005, through fakeness, Shakhawat said.

Nizam should be in prison until September 13, 2010, and he, as per the law, shouldn’t be qualified to keep running in parliamentary surveys before September 2015. Nizam gave false data about serving his correctional facility term to the Election Commission, he included.

The HC issued a control that day asking the administration and the EC to clarify for what good reason his parliament seat ought not be announced empty.

The workplace of investigator general of detainment facilities presented an answer to the HC on July 19, 2016 saying that Nizam had endured in prison around 2.5 years short of what he should serve in the arms case.

Amid hearing on the request, candidate’s legal advisor Advocate Quamrul Haque Siddique told the court that Nizam can’t hold the post of a legislator and he should serve in prison if the report of the IG penitentiaries is right.

In the mean time, Nizam’s attorneys Barrister Shafique Ahmed and Advocate Nurul Islam Sujan contradicted the request of saying that their customer had served the whole term of the prison sentence and accordingly, the appeal to was not petitioned for people in general intrigue.
