(1932) 36 CWN 774 Raza Vs. Abbas : The of property Act saves the rules mohamedan law in so far as they are inconsident with the rules contained in chapter 11 thus a mohamedan, by executing a wakf, may settle property in perpetuity for the benefit of the desendent provided there is an ultimate gift in favour of charity.This rule of Mohamedan law is not affected by section 13 and 14 of the the transfer of property Act which forbids transfers in perpetuity.But if the rules contained chapter -2 are not inconsistent with any rule of Mohamedan law,there equally applicable to Mohamedans.
